Article 1: General provisions
The e-commerce website of Hans Roels, self-employed with registered office : 2, de Hinnisdaellaan, 1150 Brussels, and company number BE 0552400647, bears the name ‘Tai, a Woven Culture’.
The website offers its customers the opportunity to purchase the products from its web store online.
These General Terms and Conditions (“Terms”) apply to any order placed by a visitor to this e-commerce website (“Customer”). When placing an order via the Hans Roels web shop, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions, to the exclusion of all other conditions. Additional terms and conditions of the Customer are excluded, unless they have been expressly accepted by Hans Roels in advance, in writing.
Article 2: Price
All prices stated are expressed in EURO or in THB, always including VAT and all other duties or taxes required by the Customer.
If delivery, reservation or administrative costs are charged, this will be stated separately.

The price statement refers exclusively to the articles as described verbatim. The accompanying photos are intended for decorative purposes and may contain elements that are not included in the price.
Article 3: Offer
Despite the fact that the online catalog and the e-commerce website have been compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer are not binding on Tai, a Woven Culture. Tai, a Woven Culture is only subject to an obligation of means with regard to the correctness and completeness of the information provided. Tai, a Woven Culture is in no way liable in the event of manifest material errors, typesetting or printing errors.
If the Customer has specific questions about, for example, sizes, colour, availability, delivery time or delivery method, we request that the Customer contact our customer service in advance.
The offer is always valid while stocks last and can be adjusted or withdrawn at any time by Tai, a Woven Culture. Tai, a Woven Culture cannot be held responsible for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.
Article 4: Online purchases
- On the Home page, click on the ‘purchase’ button
- You indicate the number of books you want to buy
- You click on the shopping cart
- You fill in your details.
- You enter collection at the book presentation, or shipping, the extra shipping costs are calculated when filling in the address and added to the amount.
- You choose method of payment and checkout.
The Customer has the choice between the following payment methods

- Credit card : Visa/Mastercard/American Express
- Paypal

- Sepa Bank Transfer
- Giropay
- KBC/CBC Payment Button
- Belfius Direct Net
There are no costs associated with the payment methods.
Tai, a Woven Culture is entitled to refuse an order due to a serious shortcoming of the Customer with regard to orders in which the Customer is involved.
Article 5: Delivery and execution of the agreement
The shipment will take place within 48 hours after receipt of payment.
Within the EU, the shipment is provided by Bpost.
In Thailand and surrounding countries, shipping is carried out by Thai Post
In all other countries, shipping is done by EMS.
Items ordered through this web store are delivered in all countries served by EMS.
Unless otherwise agreed or expressly provided otherwise, the goods will be delivered to the Customer’s place of residence within 30 days of receipt of the order. Within Belgium, Bpost delivers the shipment to your home. Within Thailand Thai Post delivers the shipment at home. In all other countries, the customer can follow the shipment via Track & Trace.
Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery must be reported by the Customer to Tai, a Woven Culture without delay.
The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by the Tai, a Woven Culture.
Article 6: Retention of title
The delivered items remain the exclusive property of Tai, a Woven Culture until full payment by the Customer.
The Customer undertakes, if necessary, to point out to third parties the retention of title of Tai, a Woven Culture, e.g. to anyone who would seize the items not yet fully paid for.
Article 7: Right of withdrawal
The provisions of this article only apply to Customers who purchase items online from Tai, a Woven Culture in their capacity as consumers.
The Customer has the right to withdraw from the agreement within a period of 14 calendar days without stating reasons.
The withdrawal period expires 14 calendar days after the day of the conclusion of the agreement.
To exercise the right of withdrawal, the Customer must inform Hans Roels, de Hinnisdaellaan 2, 1150 Brussels, Belgium, memo@hansroels.com via an unambiguous statement (e.g. in writing by post or e-mail) of his decision to revoke the agreement. The Customer can use the attached model withdrawal form for this, but is not obliged to do so.
In order to comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return or hand over the goods to Hans Roels, de Hinnisdaellaan 2, 1150 Brussels, Belgium without undue delay, but in any case no later than 14 calendar days after the day on which he has notified Hans Roels of his decision to withdraw from the agreement. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.
The direct costs of returning the goods shall be borne by the Customer.
The Customer is requested to return the items in their original condition and packaging, with all accessories supplied, and instructions for use. If the returned product is in any way diminished in value, Tai, a Woven Culture reserves the right to hold the Customer liable and claim compensation for any loss in value of the goods resulting from the use of the goods by the Customer that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.
All returned items are carefully examined. The basic principle here is that the consumer may only inspect the article as he would be allowed to do in a store. Returned items may be tried on, but must not have been used. When an item has undergone a decrease in value due to the use of the Customer, this will be charged to the Customer.
Article 8: Privacy
The controller, Hans Roels, respects the General Data Protection Regulation and the Belgian Privacy Act of 30 July 2018.
The personal data provided by you will only be used for the following purposes: the execution of the concluded agreement, processing the order, sending information about the dates of the book presentations. The legal grounds are: the execution of the agreement, the consent, the fulfilment of legal and regulatory obligations and/or the legitimate interest of the company].
You have a legal right to access and any correction, addition or deletion of your personal data. In a number of cases listed in the GDPR, you may also request that the processing of your personal data be restricted. You can also object to the processing of your personal data if you have serious and legitimate reasons for doing so which go beyond our need to process your data. These Terms and Conditions are supplemented by other terms and conditions explicitly referred to and the Tai, a Woven Culture general terms and conditions of sale. In the event of a conflict, these Terms and Conditions shall prevail.
Article 12: Evidence
The Customer accepts that electronic communications and backups can serve as evidence.
Article 13: Applicable law – Disputes
Belgian law applies, with the exception of the provisions of private international law regarding applicable law.
The courts of the Consumer’s place of residence have jurisdiction in legal disputes. The Consumer can also contact the ODR platform (http://ec.europa.eu/consumers/odr/).

Artikel 1: Algemene bepalingen
De e-commerce website van Hans Roels, zelfstandige met maatschappelijke zetel : de Hinnisdaellaan 2, 1150 Brussel, en ondernemingsnummer BE 0552400647, draagt de naam ‘ Tai, a Woven Culture’
De website biedt haar klanten de mogelijkheid om de producten uit haar webwinkel online aan te kopen.
Onderhavige Algemene Voorwaarden (“Voorwaarden”) zijn van toepassing op elke bestelling die geplaatst wordt door een bezoeker van deze e-commerce website (“Klant”). Bij het plaatsen van een bestelling via de webwinkel van Hans Roels moet de Klant deze Voorwaarden uitdrukkelijk aanvaarden, waarmee hij instemt met de toepasselijkheid van deze Voorwaarden, met uitsluiting van alle andere voorwaarden. Bijkomende voorwaarden van de Klant worden uitgesloten, behoudens wanneer deze voorafgaandelijk, schriftelijk en uitdrukkelijk door Hans Roels aanvaard zijn.
Artikel 2: Prijs
Alle vermelde prijzen zijn uitgedrukt in EURO of in THB, steeds inclusief BTW en alle andere verplicht door de Klant te dragen taksen of belastingen.
Indien leverings-, reservatie- of administratieve kosten worden aangerekend, wordt dit apart vermeld.

De opgave van prijs slaat uitsluitend op de artikelen zoals het woordelijk wordt omschreven. De bijhorende foto’s zijn decoratief bedoeld en kunnen elementen bevatten die niet inbegrepen zijn in de prijs.
Artikel 3: Aanbod
Ondanks het feit dat de online catalogus en de e-commerce website met de grootst mogelijke zorgvuldigheid worden samengesteld, is het toch mogelijk dat de aangeboden informatie onvolledig is, materiële fouten bevat, of niet up-to-date is. Kennelijke vergissingen of fouten in het aanbod binden Tai, a Woven Culture niet. Tai, a Woven Culture is wat de juistheid en volledigheid van de aangeboden informatie slechts gehouden tot een middelenverbintenis. Tai, a Woven Culture is in geen geval aansprakelijk ingeval van manifeste materiële fouten, zet- of drukfouten.
Wanneer de Klant specifieke vragen heeft over bv. maten, kleur, beschikbaarheid, leveringstermijn of leveringswijze, verzoeken wij de Klant om vooraf contact op te nemen met onze klantendienst.
Het aanbod geldt steeds zolang de voorraad strekt en kan te allen tijde worden aangepast of ingetrokken door Tai, a Woven Culture. Tai, a Woven Culture kan niet aansprakelijk gesteld worden voor het niet beschikbaar zijn van een product. Indien een aanbod een beperkte geldigheidsduur heeft of onder voorwaarden geschiedt, wordt dit nadrukkelijk in het aanbod vermeld.
Artikel 4: Online aankopen
- Op de Home pagina klik je op de ‘purchase’ knop
- Je duidt het aantal boeken aan dat je wil kopen
- Je klikt op het winkelmandje
- Je vult je gegevens in.
- Je vult ophaling op de boekvoorstelling, of shipping in, de extra verzendingskosten worden bij het invullen van het adres berekend en bij het bedrag geteld.
- Je kiest wijze van betaling en checkout.
De Klant heeft de keuze tussen de volgende betaalwijzen

- Paypal

- KBC/CBC Payment Button
- Belfius Direct Net
Er zijn geen kosten verbonden aan de betaalmethodes.
Tai, a Woven Culture is gerechtigd een bestelling te weigeren ingevolge een ernstige tekortkoming van de Klant met betrekking tot bestellingen waarbij de Klant betrokken is.
Artikel 5: Levering en uitvoering van de overeenkomst
De verzending gebeurt binnen de 48 uur na ontvangst van de betaling.
Binnen de EU wordt de verzending door Bpost verzorgd.
In Thailand en omliggende landen wordt de verzending door Thai Post uitgevoerd
In alle andere landen wordt de verzending door EMS uitgevoerd.
Artikelen besteld via deze webwinkel worden geleverd in alle landen die door EMS worden bediend.
Tenzij anders overeengekomen of uitdrukkelijk anders bepaald, worden de goederen aan de woonplaats van de Klant geleverd binnen 30 dagen na ontvangst van de bestelling. Binnen België bezorgt Bpost de verzending aan huis. Binnen Thailand bezorgt Thai Post de verzending aan huis. In alle andere landen kan de klant via Track & Trace de verzending volgen.
Elke zichtbare beschadiging en/of kwalitatieve tekortkoming van een artikel of andere tekortkoming bij de levering, moeten door de Klant onverwijld worden gemeld aan Tai, a Woven Culture .
Het risico wegens verlies of beschadiging gaat over op de Klant vanaf hij (of een door hem aangewezen derde partij, die niet de vervoerder is) de goederen fysiek in bezit heeft gekregen. Het risico gaat echter al over op de Klant bij levering aan de vervoerder, als de vervoerder van de Klant de opdracht heeft gekregen de goederen te vervoeren en deze keuze niet door de Tai, a Woven Culture was geboden.
Artikel 6: Eigendomsvoorbehoud
De geleverde artikelen blijven tot op het moment van gehele betaling door de Klant, de exclusieve eigendom van Tai, a Woven Culture .
De Klant verbindt er zich toe zo nodig derden op het eigendomsvoorbehoud van Tai, a Woven Culture te wijzen, bv. aan eenieder die op de nog niet geheel betaalde artikelen beslag zou komen leggen.
Artikel 7: Herroepingsrecht
De bepalingen van dit artikel gelden enkel voor Klanten die in hun hoedanigheid van consument artikelen online aankopen bij Tai, a Woven Culture .
De Klant heeft het recht om binnen een termijn van 14 kalenderdagen zonder opgave van redenen de overeenkomst te herroepen.
De herroepingstermijn verstrijkt 14 kalenderdagen na de dag van de sluiting van de overeenkomst.
Om het herroepingsrecht uit te oefenen, moet de Klant Hans Roels, de Hinnisdaellaan 2, 1150 Brussel, België, memo@hansroels.com via een ondubbelzinnige verklaring (bv. schriftelijk per post, of e-mail) op de hoogte stellen van zijn beslissing de overeenkomst te herroepen. De Klant kan hiervoor gebruikmaken van het bijgevoegde modelformulier voor herroeping, maar is hiertoe niet verplicht.
Om de herroepingstermijn na te leven moet de Klant zijn mededeling betreffende zijn uitoefening van het herroepingsrecht verzenden voordat de herroepingstermijn is verstreken.
De Klant moet de goederen onverwijld, doch in ieder geval niet later dan 14 kalenderdagen na de dag waarop hij zijn beslissing om de overeenkomst te herroepen aan Hans Roels heeft meegedeeld, terugzenden of overhandigen aan Hans Roels, de Hinnisdaellaan 2, 1150 Brussel, België. De Klant is op tijd als hij de goederen terugstuurt voordat de termijn van 14kalenderdagen is verstreken.
De directe kosten van het terugzenden van de goederen komen voor rekening van de Klant.
De Klant wordt verzocht de artikelen terug te sturen in hun oorspronkelijke staat en verpakking, met alle erbij geleverde accessoires, en gebruiksaanwijzingen. Indien het teruggestuurde product op een of andere manier in waarde verminderd is, behoudt Tai, a Woven Culture zich het recht voor om de Klant aansprakelijk te stellen en schadevergoeding te eisen voor elke waardevermindering van de goederen die het gevolg is van het gebruik van de goederen door de Klant dat verder gaat dan nodig is om de aard, de kenmerken en de werking van de goederen vast te stellen.
Alle teruggestuurde artikelen worden aandachtig onderzocht. Het uitgangspunt hierbij is dat de consument het artikel slechts mag inspecteren zoals hij dat in een winkel zou mogen doen. Teruggestuurde artikelen mogen gepast worden, maar mogen niet gebruikt zijn. Wanneer een artikel een waardevermindering is ondergaan door het gebruik van de Klant zal dit ten laste van de Klant in rekening worden gebracht.
Artikel 8: Privacy
De verantwoordelijke voor de verwerking, Hans Roels respecteert de Algemene Verordening Gegevensbescherming en de Belgische Privacywet van 30 juli 2018.
De door u meegedeelde persoonsgegevens zullen enkel gebruikt worden voor volgende doeleinden: . de uitvoering van de afgesloten overeenkomst, het verwerken van de bestelling, versturen van info over de data van de boekvoorstellingen. De rechtsgronden zijn: de uitvoering van de overeenkomst, de toestemming, het vervullen van wettelijke en reglementaire verplichtingen en/of het gerechtvaardigd belang de onderneming].
U beschikt over een wettelijk recht op inzage en eventuele correctie, aanvulling of verwijdering van uw persoonsgegevens. U mag in een aantal gevallen opgesomd in de AVG ook vragen om de verwerking van uw persoonsgegevens te beperken. U kan zich eveneens verzetten tegen de verwerking van uw persoonsgegevens als u daar ernstige en legitieme redenen voor heeft die onze noodzaak om uw gegevens te verwerken, overstijgen. Artikel 11: Wijziging voorwaarden
Deze Voorwaarden worden aangevuld door andere voorwaarden waar expliciet naar verwezen wordt, en de algemene verkoopsvoorwaarden van Tai, a Woven Culture . Ingeval van tegenstrijdigheid, primeren onderhavige Voorwaarden.Artikel 12: Bewijs
De Klant aanvaardt dat elektronische communicaties en back-ups als bewijsvoering kunnen dienen.
Artikel 13: Toepasselijk recht – GeschillenHet Belgisch recht is van toepassing, met uitzondering van de bepalingen van internationaal privaatrecht inzake toepasselijk recht.
De rechtbanken van de woonplaats van de Consument zijn bevoegd bij gerechtelijke geschillen. De Consument kan zich ook wenden tot het ODR-platform (http://ec.europa.eu/consumers/odr/).
